According to reports, the incoming Trump administration is formulating a plan to remove undocumented immigrants from the United States, even if their home nations reject them and when President-elect Donald Trump assumes office, nations that deny migrants deportation orders from immigration judges would have to send them to other places, such the Bahamas, Grenada, Panama, Turks and Caicos, or somewhere else, according to NBC News.

Federal immigration authorities have long faced frustration with foreign governments that refuse to accept deportees. As a result, many individuals who should be deported are often released back into the U.S., even after a judge has ordered their removal.

The Biden administration’s handling of illegal immigration has seen a historic surge in unauthorized crossings. The situation worsened in February when Venezuela, the second-largest source of illegal immigrants to the U.S., stopped accepting deportation flights. Nearly 8 million Venezuelans have fled under the leadership of President Nicolás Maduro, who has overseen severe economic instability and political repression in the country. Some reports suggest Maduro’s government is pushing Trump to negotiate a deal where Venezuela would agree to accept deportees in exchange for a relaxation of U.S. sanctions.

Whether the incoming president will entertain this proposal remains uncertain. In the past, China and Cuba also resisted participating in deportation flights, but both countries have recently started accepting more deportees from Immigration and Customs Enforcement (ICE).

During his first term, Trump signed safe third-country agreements with El Salvador, Guatemala, and Honduras. These agreements required asylum seekers to apply for refuge in those countries before seeking asylum in the U.S., aiming to reduce the flow of illegal immigration. However, President Biden immediately suspended these agreements upon taking office, reversing many Trump-era immigration policies, which experts have said contributed to the border crisis.

Trump intends to carry out the most extensive deportation effort in American history after taking office. In addition, he has promised to reestablish the travel ban, remove birthright citizenship for children born to illegal immigrants, restart border wall construction, and bring back the Remain in Mexico policy, which mandates that asylum claimants remain in Mexico while their claims are being handled. The majority of experts believe that a constitutional amendment would be necessary to terminate birthright citizenship.

Trump has won a major court case before his inauguration. According to a ruling by the 9th Circuit Court of Appeals, U.S. Immigration and Customs Enforcement (ICE) is permitted to continue operating chartered deportation flights out of an airport in Seattle. A municipal executive order from 2019 that sought to prevent deportations was invalidated by this ruling. By refusing to permit deportations at King County International Airport, commonly known as Boeing Field, King County, Washington, was found to have broken its contract by the court. The decision further affirmed the federal government’s control over immigration enforcement, holding that states and local governments cannot impede these initiatives.
