Jack Smith Faces “severe consequences” after Trump Charges

Special Counsel Jack Smith, known for bringing cases against President-elect Donald Trump regarding classified documents and post-election conduct, reportedly faces scrutiny for his prosecutorial decisions. Former federal prosecutor Andrew Cherkasky suggested that Smith and his team could be investigated due to the significant costs and perceived shortcomings of these cases, according to The Daily Caller.

While criminal charges against Smith are considered unlikely, Cherkasky predicted that his unconventional legal strategies might be criticized for lacking sound judgment, potentially leading to the dismissal of others involved in these prosecutions from the Department of Justice (DOJ).

Cherkasky highlighted concerns that the January 6 congressional committee may have deliberately excluded evidence favorable to Trump, raising questions about whether Smith engaged in similar practices. Such actions could result in more severe consequences for Smith and his team if substantiated. Meanwhile, the Heritage Oversight Project has announced plans to draft a “model indictment” against Smith, citing potential civil rights violations under federal statutes.

Mike Davis, president of the Article III Project, argued that significant legal and political consequences should be imposed on Smith, whom he accused of engaging in lawfare and election interference. Davis suggested that a federal criminal investigation be pursued under 18 U.S.C.  241, citing allegations of conspiracy against rights.

Following Smith’s decision to withdraw charges against Trump, Ohio Senator and Vice President-elect J.D. Vance commented that Trump might have faced a lifetime of imprisonment had the election results differed. Vance argued that these prosecutions were politically motivated and emphasized the need to prevent similar occurrences in the future.

Reports also indicate that Trump plans to overhaul the DOJ and remove individuals involved in the cases against him once in office. His approach reportedly includes firing Special Counsel Smith and dismantling his legal team, along with career DOJ attorneys often shielded from political dismissal. Trump’s team has stated this effort is aimed at addressing the alleged misuse of the justice system for political purposes.

House Republicans have already instructed DOJ officials to retain all communications related to the Trump cases, signaling potential congressional investigations into Smith and his team. Trump’s press secretary, Karoline Leavitt, reaffirmed his commitment to holding those responsible for the “illegal weaponization” of the justice system accountable.
