Supreme Court Hands Down Major 9-0 Decision

The Supreme Court has not yet completed its work of handing down significant decisions. They are on a roll, delivering important rulings for the people of the United States of America as this session comes to a close. The most recent lawsuit involves physicians who are being investigated for allegedly prescribing excessive amounts of medication. The court agreed with the physicians in a unanimous decision (nine to zero).

It would appear that federal prosecutors were targeting two physicians with the Controlled Substances Act in an effort to bring them to justice. Both of these physicians felt it was important to defend themselves against these allegations because a conviction would have ended their careers (and perhaps put them in jail).

According to the unanimous decision of the court, medical professionals can only be held accountable for violations of the CSA if they “knowingly” acted in an “unauthorized manner.”Because of this decision, medical professionals are shielded from potential legal action and other charges.If medical professionals anticipated persistent harassment from the government, it’s possible that they would be reluctant to even treat a patient.

Because of the risk of being sued or arrested, it is possible that, in the long run, there will be a reduction in the number of people entering this profession. However, this decision places restrictions on the ways in which the government can prosecute a physician. It would appear that the court is saying that a physician cannot be held legally responsible for their actions if they treated a patient to the best of their abilities.

This decision is extremely important, particularly in light of the current times. Anyone with a smartphone believes they are more knowledgeable than their own physician. And in yet another example of the government overstepping its bounds, prosecutors in the Department of Justice who were appointed by former Vice President Joe Biden may be overly eager to prosecute a doctor. This ruling has the potential to turn the tide against the never-ending wave of attacks against medical professionals and free them to do what they do best: treat those who are ill.
